We use a referral process to help determine whether a proposed action is controlled under the Environment Protection and Biodiversity (APBC) Act. [Link to federal register of legislation]

Referral process

Anyone can make a referral to us.

Each referral is subject to a 10 day period of public comment. We will then use this to help inform our decision on whether the EPBC Act applies. We publish this decision within 20 days.

The person making the referral may then need to apply for approval under the EPBC Act.
